Talking to our friends it became clear we all took different directions and made many different decisions to achieve the same thing.
On the whole, most of them are happy but some made costly mistakes based on bad advice and poor guidance. After finding the right property the next step could have been daunting. Our estate agent told us we needed a solicitor as soon as possible. He recommended one which we declined.
Our research strongly advised the use of an independent solicitor and to avoid one tied to a builder, developer or estate agent as the advice given may not be impartial or in our best interest. A British couple running a successful business recommended their solicitor. Try and find a solicitor who puts themselves in your place and considers all the implications of your circumstances. Try and find a solicitor who makes themselves accessible to you virtually 24 hrs a day providing you with their personal mobile number and being happy to talk to you even on a bank holiday if the case is urgent.Try and find a solicitor who seems as much a friend as a legal representative. Who will put themselves out, if need be travel to you, attend meetings with you, make investigations and find out information for you. If you are lucky enough to find someone like this it would be so useful if they spoke perfect English so you understood everything completely. All my wife and I can say is to try and find a solicitor who does all this and actually cares about their clients. We were lucky.

I would like to take this opportunity to thank you most sincerely for the way you are handling our case against the most unscrupulous Spanish builder I have ever encountered, by giving away our property when finished at Orihuela Costa to a window cleaner on the urbanisation. This has robbed my wife and myself of 78,000euros. At my age of 72 and a great grand father this represented my life’s savings, coupled with a mortgage on the property of which I do not now own. The bank does not see it that way and I cannot blame them but I must still pay a monthly mortgage for a property occupied by a friend of the builder.

The efforts of both you and your esteemed father in fighting this on my behalf is commendable and gives credence to the honourable Spanish Lawyers, of which these seem to be few and far between. Regarding the Spanish judicial system with the judges being in the pockets of the builders, this also is criminal. You not only took on this most difficult case to fight the Builder with their millions, but did it without demanding vast sums of money from ourselves; this also is a credit to your integrity. The criminal action you are pursuing will eventually come to court and hopefully these builders will suffer just part of that which my wife and myself have been suffering over the past year, selling all our furniture, both our cars, having our pet put down and moving back to UK penniless. This has involved swallowing my pride and going cap in hand to our UK government to assist in accommodation and putting us on income support to supplement our meagre income while still having to pay the mortgage on a property now owned by someone else.

If someone in the UK stole money from you the police would become involved immediately, however this does not appear to be the case in one of our so called European partners, Spain.

As there is no official channel in Spain for people suffering this type of criminal injustice to appeal to and the judge you presented the initial case to turning a deaf ear and siding with San Jose, again I thank you for your efforts on our behalf for submitting it to the criminal court.
